We advocate for legalizing marijuana for adult use. 

New Mexico’s current cannabis policies are defined by prohibition and have resulted in profound harms. Prohibition is the absence of control. Under prohibition there is no legal oversight for consumers. And people of color, young people and poor people are most likely to bear the consequences of being criminalized for marijuana use and sales. 

Legalizing marijuana for adult use is an opportunity to grow New Mexico, keeping us true to our values and the things we care most about: the wellbeing of our children, community health, and the future of our state. Sixty-three percent of (63%) of New Mexico adults support the legalization, regulation, sales to adults 21 & over, and taxation of cannabis. (Research & Polling Inc., 2018)
 
We can change this and establish policy that ensures equity and diversity, while reinvesting in communities hardest hit by marijuana criminalization. 

  • Marijuana legalization must address the ongoing, damaging consequences of marijuana criminalization, including sealing records and changing administrative agency regulations to address directly impacted people;
  • Marijuana legalization must create a diverse and inclusive industry;
  • The new revenue from marijuana legalization must be used to reinvest in communities that have been impacted by prohibition.

Legalizing marijuana is a path to prosperity for New Mexico. Not only will it increase tax revenue, and generate commerce, marijuana legalization supports local and  agricultural economies. It is smart policy that keeps kids safe. 

The Drug Policy Alliance is working to end marijuana prohibition and protect the rights of medical marijuana patients in New Mexico. Since 2012 DPA has been advocating at the New Mexico state legislature for passage of legislation allowing the possession, use, and sales of marijuana. In 2016 this measure made history when a Constitutional Amendment was heard on the Senate Floor; it was narrowly defeated by a five (5) vote margin. 2019 represents a new era in New Mexico and we are optimistic about moving forward a bill to allow possession, use, production and sales for cannabis for adults over 21 years old.
